<title><![CDATA[Samsung wins ITC ban of AT&amp;T compatible iPhones and iPads due to patent infringement]]></title>

<p>Samsung got a big win in the International Trade Commission today, as the ITC handed down a final ruling finding that several models of AT&amp;T-compatible iPhones and iPads infringe a Samsung patent, and issued an exclusion order preventing them from being imported, sold or distributed in the US. This final ruling comes months after an <a href="http://www.engadget.com/2012/09/14/itc-says-apple-didnt-violate-four-samsung-patents/?utm_source=Feed_Classic&amp;utm_medium=feed&amp;utm_campaign=Engadget">ALJ determined</a> that Apple did not infringe any of Samsung's IP, but clearly, the commission felt differently upon its review. This final determination holds that AT&amp;T models of the iPhone 4, 3GS and 3G, plus AT&amp;T iPad 3G and iPad 2 3G models infringe four claims of Samsung's patent number 7,706,348 for encoding mobile communications.</p>

<p>The ITC reversed the ALJ's ruling in part based upon modified construction of several key terms in the claims at issue, but upheld the prior decision regarding the other three patents Samsung asserted in the action. So, what does this mean for Apple? Not a tremendous amount, truthfully, as the newly banned devices are no longer Cupertino's standard bearers and account for little of <a href="http://www.engadget.com/2013/04/23/apple-posts-q2-2013-earnings/?utm_source=Feed_Classic&amp;utm_medium=feed&amp;utm_campaign=Engadget">massive profits</a>. Plus, Apple will, no doubt appeal the decision in court. Still, Samsung's bound to feel pretty good about the victory, and every little bit helps in its quest to remain <a href="http://www.engadget.com/2013/05/14/gartner-android-samsung-q1-2013/?utm_source=Feed_Classic&amp;utm_medium=feed&amp;utm_campaign=Engadget">atop the smartphone heap</a>, right?</p>

As it stands, the case involves seven patents that mostly touch on staple technologies of the modern mobile world, such as syncing messages between devices and bookmarking media playback on one device to resume on another. Does that last technique sound familiar? You might recall it being a cornerstone of the movie and podcast support that Apple has implemented <a href="http://www.engadget.com/2005/05/23/itunes-4-9-adding-support-for-podcasts/?utm_source=Feed_Classic&amp;utm_medium=feed&amp;utm_campaign=Engadget">since 2005</a>. Despite reaching that far back into history, Motorola is just as eager to modernize the targeted hardware list to keep its complaints relevant -- the <a href="http://www.engadget.com/2012/03/16/apple-ipad-review-2012/?utm_source=Feed_Classic&amp;utm_medium=feed&amp;utm_campaign=Engadget">current iPad</a>, the <a href="http://www.engadget.com/2011/10/14/iphone-4s-review/?utm_source=Feed_Classic&amp;utm_medium=feed&amp;utm_campaign=Engadget">iPhone 4S</a> and other devices are at risk of a trade ban, posing more of a threat to Apple's bottom line than the dust-covered (and <a href="http://www.engadget.com/2012/04/24/itc-judge-finds-apple-in-violation-of-motorola-wifi-patent/?utm_source=Feed_Classic&amp;utm_medium=feed&amp;utm_campaign=Engadget">near-finished</a>) <a href="http://www.engadget.com/2010/10/06/motorola-suing-apple-for-patent-infringement/?utm_source=Feed_Classic&amp;utm_medium=feed&amp;utm_campaign=Engadget">initial legal challenge</a> from October 2010. Before coming to any conclusions, though, remember that the newer complaint isn't likely to have any speedy resolution of its own. Past <a href="http://www.engadget.com/tag/ITC/?utm_source=Feed_Classic&amp;utm_medium=feed&amp;utm_campaign=Engadget">ITC</a> cases have usually taken a year and a half to complete, which could leave most or all of today's technology as another distant memory.</p>

With the exception of Safari's Offline Reading List, the only features now left out for iPhone 3GS owners are the ones you'd expect to be excluded from a 3-year-old phone, such as FaceTime, Siri and those 3D-heavy map flyovers. A few months of work by iOS hackers Grant Paul (aka chpwn), Steven Troughton-Smith and Ryan Petrich has culminated in the release of Spire, a new installer that will easily set up <a href="http://www.engadget.com/tag/siri?utm_source=Feed_Classic&amp;utm_medium=feed&amp;utm_campaign=Engadget">Siri</a> on your jailbroken iOS 5 device. While Apple has kept its little helper <a href="http://www.engadget.com/2011/10/04/apple-brings-siri-voice-control-to-iphone/?utm_source=Feed_Classic&amp;utm_medium=feed&amp;utm_campaign=Engadget">exclusively constrained to the iPhone 4S</a>, it now runs on iPads, <a href="http://www.engadget.com/2011/10/15/siri-ported-to-an-iphone-4-old-phone-learns-a-new-trick/?utm_source=Feed_Classic&amp;utm_medium=feed&amp;utm_campaign=Engadget">iPhone 4</a>, iPod touches and the iPhone 3GS, and while that's <a href="http://www.engadget.com/2011/11/08/siri-ported-iphone-3gs-likes-to-kick-it-old-school-video/?utm_source=Feed_Classic&amp;utm_medium=feed&amp;utm_campaign=Engadget">been done before</a> they claim the other new trick is that it's legal, avoiding the copyright infringement inherent in previous hacks. When installed it will initiate a 100MB download of Siri directly from Apple so watch your bandwidth limits, and also be prepared to set up your own proxy server with donated info from an iPhone 4S to hold the line between Apple's backend and yourself. It's available on Cydia now so if you've been waiting for a way to get this feature for yourself it's not far away, however Troughton-Smith tells <i>9to5 Mac</i> that the next major step may not come until the iPhone 4S is jailbroken and they can avoid the proxy server issues altogether.

A new build of ultrasn0w just hit the Cydia app store, with v1.2.5 adding more support for iOS 5.0.1. Of note, novice jailbreakers may want to reach out to more experienced pals before embarking, as you'll need a a compatible baseband in order for the <a href="http://www.engadget.com/tag/unlock/?utm_source=Feed_Classic&amp;utm_medium=feed&amp;utm_campaign=Engadget">unlock</a> to work. The iPhone 3GS (running iOS 5.0.1.) is supported with the following basements: 04.26.08 - 05.11.07 - 05.12.01 - 05.13.04 - 06.15.00. The iPhone 4 is supported if your baseband checks in as 01.59.00. If you're looking to upgrade from a dustier firmware, make sure you preserve your baseband before unlocking. Unfortunately for them, ever since a recent update on the 16th they haven't been able to download any new apps from the App Store straight to their devices. While users of older iPod Touches and iPhones stuck on <a href="http://www.engadget.com/2010/02/02/iphone-os-3-1-3-available-now/?utm_source=Feed_Classic&amp;utm_medium=feed&amp;utm_campaign=Engadget">3.1.3</a> by choice or incompatibility with newer OSes can still update the apps they already have and transfer software from iTunes on a computer, they can't buy or install new ones directly from the device. We were able to confirm the issue on one of our own devices, while there's a pretty lengthy thread in Apple's support forum about the issue, but no official response yet. We'll keep you posted if word comes that this is just a glitch or if the company has decided to leave those old versions on the outside looking in.<br />

	After issuing a default judgment <a href="http://www.engadget.com/2011/11/04/german-court-grants-injunction-against-apple-for-infringement-of/?utm_source=Feed_Classic&amp;utm_medium=feed&amp;utm_campaign=Engadget">against Apple</a> last month, Germany's Mannheim Regional Court has now granted a "preliminarily enforceable" injunction against Ireland-based Apple Sales International, on the grounds that its products may violate some of Motorola Mobility's patents. At issue is Motorola's European Patent 1010336 (B1), which covers a "method for performing a countdown function during a mobile-originated transfer for a packet radio system." According to <em>Foss Patents</em>, the court's injunction encompasses the iPhone (3G, 3GS and 4), iPad 3G and iPad2 3G. The ruling also states that Apple can avoid the injunction if it removes the patent-infringing elements from its devices, though it's more likely that Cupertino will appeal to the Karlsruhe Higher Regional Court, in the hopes of obtaining a stay. We've already reached out to Apple for comment, and will update this post as soon as we get more information.<br />

	<strong>Update:</strong> <span dir="ltr" id=":1t5">And as expected, Apple intends to appeal the ruling which, if enforced, would only apply to future shipments. So grab that existing stock while you can.</span></div>

Thanks to Siri0us, the free app available through <a href="http://www.engadget.com/tag/cydia?utm_source=Feed_Classic&amp;utm_medium=feed&amp;utm_campaign=Engadget">Cydia</a>, users will gain the option to speak messages and search queries rather than type them, which could be a huge time saver -- unless there's a series of mistakes, anyway. Rather than accessing Apple's own system, the app works by tapping into Nuance's Dragon Go servers for speech recognition. Rather subversive, don't you think? <em><strong>Update:</strong></em> Well, who didn't see this one coming? Nuance has pulled the rug out from under Siri0us, and the app has been yanked from Cydia while the developer searches for another speech recognition server. Happy hunting, dude.

Of all the <a href="http://www.engadget.com/2011/10/12/ios-5-review/?utm_source=Feed_Classic&amp;utm_medium=feed&amp;utm_campaign=Engadget">enhancements</a> to discover in Apple's <a href="http://www.engadget.com/tag/ios+5?utm_source=Feed_Classic&amp;utm_medium=feed&amp;utm_campaign=Engadget">iOS 5</a> upgrade, it seems that an unforeseen <a href="http://www.engadget.com/2011/10/29/poll-whats-broken-or-working-for-you-in-ios-5/?utm_source=Feed_Classic&amp;utm_medium=feed&amp;utm_campaign=Engadget">monster</a> may have snuck its way into the release. We're now reading through a handful of user complaints about losing WiFi after taking the plunge, with most replies mentioning intermittent connectivity and / or a significant loss in signal strength. The issue remains unconfirmed by Apple, but it appears to span across a number of devices, including the iPhone 4S, 4 and 3GS, along with the iPad (and possibly, the iPod Touch). By troubleshooting, one user was able to resolve the problem by reverting to iOS 4.3, then cause it to manifest -- once again -- by upgrading to iOS 5. The recent iOS 5.0.1 update certainly hasn't fixed the matter, either. Could these reports be an unfortunate series of unrelated events, or is there something larger at play?
